Terms & Conditions
The full agreement governing services, memberships and warranties provided by YK Services (a trading name of YK Worldwide Ltd).
Nothing in these Terms & Conditions shall restrict or exclude the statutory rights of a consumer under the Consumer Rights Act 2015 or any other applicable UK legislation.
1. Definitions
- Company: YK Worldwide Ltd trading as YK Services
- Customer: Any individual or entity authorising work
- Vehicle: Any motor vehicle presented for inspection, repair, testing, storage, or recovery
- Work: Any diagnostics, labour, servicing, repair, testing, strip-down, road testing, or advice
- Goods: Parts, components, fluids, consumables, or materials supplied
2. Formation of Contract
2.1These Terms & Conditions, together with any quotation, invoice, job card, work authorisation form, electronic message, or key handover, constitute the entire agreement.
2.2Authorisation of work by any means constitutes acceptance of these Terms & Conditions.
2.3No variation shall be valid unless agreed in writing by the Company.
3. Ownership & Authority
3.1The Customer warrants legal ownership or full authority to instruct the Company.
3.2The Company accepts no liability for ownership, finance, or third-party disputes.
4. Estimates & Quotations
4.1Estimates are non-binding.
4.2Estimates may change where additional faults are discovered.
4.3Safety-critical work may be carried out without further approval.
4.4Diagnostic charges are payable regardless of repair outcome.
5. Diagnosis & Fault Finding
5.1Diagnosis is based on symptoms present at inspection.
5.2Not all faults can be identified.
5.3Diagnosis does not guarantee a repair outcome.
6. Intermittent & Latent Faults
6.1Intermittent or dormant faults may not be detectable.
6.2The Company is not liable for faults not present during inspection.
7. Strip-down & Investigative Authority
7.1The Customer authorises partial or full strip-down as required.
7.2Strip-down labour is chargeable regardless of outcome.
7.3Vehicles deemed uneconomical remain chargeable for work undertaken.
8. Parts & Materials
8.1Parts may be OEM, aftermarket, reconditioned, or used.
8.2Electrical, special-order, and fitted parts are non-returnable.
8.3Manufacturer warranties apply to parts only.
8.4Supplier delays are outside Company control.
8.5The Company is not liable for failure of parts supplied by third-party manufacturers or suppliers.
9. Customer-Supplied Parts
9.1No warranty or liability is accepted for customer-supplied parts.
9.2Labour remains chargeable regardless of part failure.
10. Workmanship Warranty
10.1Labour is warranted for 3 months or 3,000 miles.
10.2Warranty excludes wear, misuse, overheating, abuse, tuning, racing, and third-party interference.
11. Pre-existing Conditions
11.1No liability is accepted for failures caused by:
- Age
- Mileage
- Corrosion
- Prior poor repairs
- Component fatigue
12. Consequential & Cascade Failures
12.1Repairs may expose or accelerate failure of weakened components.
12.2Such failures do not constitute negligence.
13. Engine, Timing & Internal Component Risk
13.1Timing and internal engine work carries inherent risk.
13.2Internal components cannot be fully inspected without full disassembly.
13.3Pre-existing internal damage remains the Customer's responsibility.
14. No Guarantee of Outcome
14.1The Company provides a service, not a guaranteed result.
14.2No assurance is given that further faults will not occur.
14.3The Company does not guarantee that any repair will resolve all faults or restore the vehicle to full working condition.
15. Warning Lights & Dash Indicators
15.1Warning lights may return after repair.
15.2Resolution is not guaranteed unless stated in writing.
16. Electrical, Software & Programming
16.1No liability for faults arising from:
- Software updates
- Coding
- ECU adaptations
- Voltage issues
17. Battery & Voltage-related Faults
17.1Low voltage may cause multiple system faults.
17.2The Company is not liable for voltage-related failures.
18. Road Testing
18.1Vehicles may be road tested for diagnostic purposes.
18.2No liability for faults arising during lawful testing unless proven negligence.
18.3The Company shall not be held liable for breakdown or failure occurring during road testing unless directly caused by proven negligence.
19. Customer Obligations
19.1The Customer must disclose all known faults and modifications.
19.2Failure to disclose may invalidate warranties.
19.3Vehicles must be collected promptly.
20. Payment Terms
20.1Payment is due immediately upon completion.
20.2Payment methods include cash, card, or bank transfer.
20.3The Company reserves the right to charge reasonable recovery, administrative, and legal costs associated with unpaid invoices.
21. Mechanic's Lien
21.1The Company may retain the Vehicle and keys until paid in full.
21.2Possession will not be released without settlement.
22. Storage
22.1Vehicles uncollected after 7 days may incur storage fees.
22.2Storage continues until payment and collection.
23. Title & Risk
23.1Title to Goods remains with the Company until payment.
23.2Risk passes on collection.
24. Limitation of Liability
24.1No liability for indirect or consequential loss.
24.2Liability capped at value of Work carried out.
25. Abusive or Threatening Conduct
25.1The Company may cease work immediately.
25.2Charges remain payable.
26. Chargebacks & Payment Disputes
26.1Customers must contact the Company before initiating disputes.
26.2Fraudulent chargebacks will be pursued.
27. Dispute Resolution
27.1Customers must allow the Company opportunity to inspect and respond.
27.2Independent professional evidence is required for negligence claims.
28. Unpaid & Uncollected Vehicles (Torts Act)
28.1Vehicles unpaid/uncollected after 3 months may be treated as abandoned.
28.2Notice will be issued under the Torts (Interference with Goods) Act 1977.
28.3Vehicles may be sold to recover lawful costs.
28.4Surplus funds will be held for the owner.
29. Customer Declines Repairs
29.1Where the Customer declines recommended repairs, the Company accepts no liability for any resulting faults, damage, or failure.
30. Timeframe Protection
30.1Any timeframes provided are estimates only and do not constitute a guaranteed completion date.
31. Data Protection
31.1Data handled under UK GDPR.
31.2Data retained for legal and accounting purposes.
32. Force Majeure
32.1No liability for events beyond reasonable control.
33. Severability
33.1Invalid clauses do not affect remaining terms.
34. Entire Agreement
34.1These Terms supersede all prior representations.
35. Governing Law & Jurisdiction
35.1England & Wales courts have exclusive jurisdiction.
36. Out-of-Hours, Bank Holiday & Emergency Surcharges
36.1YK Services operates a 24/7 booking system. Any work carried out outside of standard hours, on bank holidays, or as an emergency callout is subject to the following surcharges, which are added to the final quote and confirmed to the Customer before any work commences.
36.2Night-rate (out-of-hours): A flat surcharge of £25 applies to any booking with a preferred start time between 23:00 and 04:59 on a regular (non-holiday) day.
36.3UK bank holidays (England & Wales): A surcharge of 25% of the full quote (parts and labour) applies to any booking scheduled on a recognised bank holiday (any time of day).
36.4Emergency / breakdown callouts on a bank holiday: Where the Customer selects "Emergency / Breakdown" as the service type AND the booking falls on a UK bank holiday, a surcharge of 35% of the full quote (parts and labour) applies (this replaces, and does not stack with, the standard 25% bank-holiday rate).
36.5Christmas Day & New Year's Day: A surcharge of 50% of the full quote (parts and labour) applies to any booking scheduled on the 25th of December or the 1st of January, regardless of time of day or service type. This is the highest applicable rate and replaces all other surcharges for that day.
36.6No stacking: Where more than one surcharge could apply (for example, a 03:00 booking on a bank holiday), only the single highest-value surcharge is applied. Surcharges are never added on top of one another.
36.7Percentage-based surcharges are calculated against the full quote — both parts and labour. The flat £25 night-rate is added as a separate line. Third-party recovery fees (e.g. specialist tow-in) are itemised separately at cost.
36.8Surcharge eligibility is shown to the Customer at the point of booking (a badge appears on the relevant time slot and a notice appears once the slot is selected). By submitting the booking the Customer acknowledges and accepts the applicable surcharge.
36.9The Company reserves the right to review these rates from time to time. Any change will apply only to bookings made after the rate is updated; bookings already confirmed will honour the rate in force at the time of confirmation.
37. Third-Party Payment Responsibility
37.1Any arrangement whereby a dealership, warranty provider, finance company, insurer, employer, family member, friend, or any other third party is expected to contribute toward or fully cover the cost of diagnostics, repairs, recovery, storage, inspections, or associated services must be confirmed directly with YK Services in writing prior to commencement of any work.
37.2In the absence of written confirmation accepted by YK Services before work begins, the individual booking, authorising, requesting, or delivering the vehicle for service shall remain solely and fully responsible for all invoices, charges, fees, and associated costs.
37.3By proceeding with any booking, inspection, diagnostic, repair, recovery, or associated service, the customer acknowledges and agrees that:
37.4Payment made by the customer for completed or authorised services shall constitute acceptance of the charges invoiced unless otherwise disputed in writing prior to payment being processed.
All work is undertaken subject to these Terms & Conditions. Authorisation confirms full acceptance.
